Privacy Policy
Who we are
We collect only what we need to reply to you and run this website, and we never sell it. This policy explains what that means in practice.
Brandyard Inc. ("Brandyard", "we", "us") is a branding and design studio based in Metro Manila, Philippines. We are the personal information controller for data collected through thebrandyard.com (the "Site").
This policy covers the Site and any messages you send us through it. It is written to comply with the Philippine Data Privacy Act of 2012 (Republic Act No. 10173), its Implementing Rules and Regulations, and issuances of the National Privacy Commission.
It does not cover personal data we handle while working with clients on a project. That is governed by our agreement with each client.
What we collect and why
We collect personal data in three ways, each for a specific purpose.
Where it comes from | What we collect | Why we use it | Legal basis |
|---|---|---|---|
Visiting the Site | Basic usage data such as pages viewed, device and browser type, approximate location, and referring page | To understand how the Site is used and keep it running well | Our legitimate interest in maintaining the Site |
Job applications (via our Typeform application form) | Name, contact details, CV, portfolio, and anything else you choose to share | To assess your application and contact you about roles | Your consent |
Contact form | First and last name, email, company name, the service you're interested in, and your message | To reply to your enquiry, discuss a potential project, and prepare a proposal | Your consent, and steps you ask us to take before entering a contract |
Please don't send us sensitive personal information (such as health, religious, or government ID details) through the Site. We don't need it to respond to you.
We don't use your data for automated decision-making or profiling. We will only send you marketing emails if you've separately agreed to receive them.
Cookies and site analytics
The Site is built and hosted on Wix, which places cookies needed for the Site to work, keep it secure, and produce basic visitor statistics for us. We don't currently use third-party advertising or tracking tools. Wix's own privacy and cookie policies explain the cookies it uses. You can block or delete cookies in your browser settings, though some parts of the Site may not work properly.
If we add analytics tools such as Google Analytics in future, we'll update this section and ask for your consent where required.
Who we share it with
We don't sell, rent, or trade your personal data. We share it only with service providers that help us run the studio, under terms that require them to protect it:
-
Wix.com — website hosting, forms, and visitor statistics
-
Typeform — our job application form
-
Our email and workspace tools — to receive and manage your messages
These providers may store data on servers outside the Philippines. Where that happens, we rely on their contractual and security commitments to keep your data protected to a standard comparable to Philippine law.
We may also disclose personal data if the law requires it, or to protect our rights in a legal matter.
How long we keep it
We keep personal data only as long as we need it:
-
Enquiries that don't lead to a project: up to 3 years from our last exchange
-
Enquiries that become client work: for as long as the relationship lasts, plus any period required for tax and accounting records
-
Job applications: up to 2 years, so we can reach out if a suitable role opens, unless you ask us to delete it sooner
After that, we delete or anonymise it.
How we protect it
We use reasonable organisational, physical, and technical measures to protect your data. Access is limited to team members who need it, accounts are password-protected, and the Site runs over a secure (HTTPS) connection. No system is completely secure, but if a breach affecting your data occurs, we will notify you and the National Privacy Commission as the law requires.
Your rights
Under the Data Privacy Act, you have the right to:
-
Be informed about how your personal data is collected and used
-
Access the personal data we hold about you
-
Correct data that is inaccurate or incomplete
-
Object to processing, or withdraw consent at any time
-
Erase or block data that is no longer needed or was processed unlawfully
-
Data portability — get a copy of your data in a commonly used electronic format
-
Claim damages if you suffer harm from inaccurate or unlawfully processed data
-
File a complaint with the National Privacy Commission
